Terms

Access is by invitation. The service may change, break, or be unavailable at any time without notice, and any feature may be modified or removed. We may suspend or end the preview, or any account’s access, at any time, for any reason or none, with or without notice.

There is no uptime commitment and no support commitment. Do not rely on RebackFM as the only copy of anything.

You keep whatever rights you already had in the emails you forward, and you are responsible for having the right to forward them.

You grant us a worldwide, non-exclusive, royalty-free, fully paid, sublicensable and transferable licence to host, store, copy, transmit, display, adapt, translate, process and create derivative works from that content, and from the scripts and audio produced from it, for the purposes of operating, securing, supporting, improving and developing RebackFM. This licence lasts for as long as we hold the content, including in backups, and survives the closing of your account to the extent copies remain.

Do not use the service for material you are not entitled to, or in a way that breaks the terms of the publications you subscribe to. You, and not us, are responsible for what you forward and for the consequences of forwarding it.

Do not attempt to break, overload, probe, reverse-engineer or gain unauthorised access to the service; do not use it to process unlawful material; do not resell or redistribute it; and do not use it in any way that harms us, the service, or anyone else. We may set and change limits on use, and we may remove content or restrict, suspend or close an account at our discretion.

Your feed is private to you, but anyone holding its address can play it. Treat that address like a password.

RebackFM is free during the preview. We may introduce charges for the service or any part of it in future, and we will tell you before any charge applies to you.

The service, including anything it produces, is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement.

We do not warrant that the service will be uninterrupted, timely, secure or error-free, or that any script or audio it produces will be accurate, complete or suitable for any purpose. It is produced by automated processing, which makes mistakes; do not rely on it where accuracy matters. We are not responsible for failures or delays caused by events outside our reasonable control.

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost data, lost profits, lost revenue, loss of goodwill or business interruption, arising out of or relating to RebackFM, whether or not we were advised that they were possible.

Our total liability for all claims relating to RebackFM will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or one hundred United States dollars. These limits apply even if a remedy is found to have failed of its essential purpose.

Nothing here limits liability that cannot lawfully be limited. Some places do not allow some of these exclusions, so parts of this section may not apply to you.

You will indemnify us against, and hold us harmless from, any claim, demand, loss, liability or expense, including reasonable legal fees, arising out of the content you forward, your use of the service, or your breach of these terms.

RebackFM depends on services operated by others, including hosting, email routing, storage and language-model providers, and it links to podcast apps and other sites. We are not responsible for those services, for their availability, or for their terms.

We may change these terms at any time. The date at the top of this page changes when the text does, and continuing to use RebackFM after a change means you accept the new terms. If you do not accept them, stop using the service.

These terms, and any dispute arising out of them or out of RebackFM, are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware, and each of us waives any objection to venue there.

If you are a consumer, this does not deprive you of the protection of any mandatory law of the country where you live.

If any part of these terms is unenforceable, the rest still applies, and the unenforceable part is limited to the minimum extent necessary rather than removed. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may, including to a successor in a merger, acquisition or sale of assets. These terms and the privacy page are the entire agreement between you and us about RebackFM, and they replace anything said before. The sections on content licence, acceptable use, warranties, liability, indemnity, governing law and this section survive.
